A surprise legal maneuver by the defense in the Sarah Palin hacking case could undermine key charges carrying the stiffest potential penalties. A lawyer for the Tennessee college student charged with hacking into the Alaska governor’s Yahoo e-mail account last year says his client couldn’t have violated Palin’s privacy because a judge had already declared her e-mails a matter of public record.

Being required to keep your e-mails as part of a court case, releasing them to the public, and finally determination of which e-mails are personal and which ones are not is a decision for the court to make. Not some college kid from Tennessee. The right to privacy does extend into the internet and i think he should not only go to jail but from on forward everything he transmits electronically, via e-mail, facebook, twitter or even text message should be posted for everyone to read. Maybe then someone else will learn from his example and keep their noses out of other peoples business. Of course the other corallory ( i know it's misspelled) is that if you do something like this keep your mouth shut and not post them on the internet. Obviously if he could hack into Palin's account then somebody could hack into his.

These poor old judges are just so technologically challenged. They have already ruled as late as 1997, that e-mail belongs to the provider or the none who owns the server. Personal e-mail by a Governor or any public person does not automatically make it a matter of public record. If so, all communication, including telephone conversations telling her husband to bring home some bread would be public record, too. Better think that one over, Your Honor.

If we give our e-mail address out to our friends and other business we expect that they will honor our privacy . Any one who HACK into our accounts are violating our rights of privacy .I don't care who you are if you violate someone privacy you have broken the LAW . If not on a legal issue it is most certainly on a moral issue. I'm sure if someone broke into his personal information he would feel like he had been raped just like the rest of us would feel ,so why should it be any different for Gov. Palin.
