Judge in Prop 8 Trial Is Gay
Turns out 9th District Court of Appeals Judge Vaughn Walker, who is currently considering testimony in the closely watched marriage-rights case regarding the constitutionality of California's Proposition 8, is himself gay.
Not that there's anything wrong with that!
Now, this doesn't come as a surprise to many who closely follow gay-rights issues or the federal courts. State Senator Mark Leno told the Chronicle that it seemed curious it "was never discussed."
Asked if he had any problem with the issue of his sexuality being raised so publicly, Walker responded "No comment."
While it might seem like an advantage to Prop 8 proponents, Walker's sexuality doesn't provide easy grounds for an appeal should he strike down the ban on same-sex marriage.
"Every judge has a race," said David Levine, a professor at the University of California's Hastings School of Law. "Does that mean when there's a case involving racial discrimination, no judge can decide a case involving race because they have a race? No."

But the final say will be the Supreme Court, not this judge. Gays will eventually marry and enjoy all of the benefits of our Constitution and Bill of Rights just as Black American's and Women have and in spite of the spiteful religious nuts in this accepting country of ours. American embraces the gay person as it does the looney evanglists and their crazed followers. That is if our Constitution isn't 're-engineered' by whatever radical happens to be in the Administration at the time. Hopefully, Obama will at least keep his promises to the gays. As long as same-sex couples are law abiding citizen the state has no substantive reason to deny them access to the legal institution of civil marriage and it also has no business creating a separate institution in order to sub jugate them to a ‘separate but equal’ status.

Hobbes, we've witnessed a real life slippery slope by the gay movement for a long time. NOTHING is good enough for them, short of outright APPROVAL of their lifestyle at this point. The slippery slope theory is a good argument if you know the history of the gay movement, which has been a very slippery slope indeed, historically speaking.

Polygamy is a substantially different issue; it would require a complete overhaul of how the government regulates marriage. As it redefines the number of parties involved, it would probably be completely impossible to sanction and regulate. The state has no substantive reason to deny law abiding same-sex couples access to the legal institution of civil marriage. The state does however have a substantive reason to restrict the number of people who enter into a marriage contract.
