This thing is set up.The Gov. has been building a defense for KSM for criminal court. Here's why.
#1 Establishment that water-boarding is torture.
#2 Miranda rights weren't given. Violate any the man walks.
Both of these give KSM the greatest chance to walk.
KSM confessed only when water-boarded. Confession inadmissible. Obtained under duress.
Under Fed. court system miranda rights have to be given. KSM caught in Pakistan where none given. He walks, applies for welfare and gets a check and stamps thanks E. Holder.

SENATOR LINDSEY GRAHAM did his usual job of making someone look stupid and then making his own statement of opinion. Eric Holder Jr. Danced and parried and finally called the Ben Laden example a red herring. In this case Senator Graham was heading in the right direction. The ONLY reason they are trying KSM in federal court is for show. To make an example of him. They hope to make him look like a common criminal, a thug. They risk damaging our ability to fight our enemies in battle, they risk damaging our ability to take and question prisoners on the battlefield, and they risk damaging our judicial system by using it for a purpose it was never intended. They risk all of this for show. We are not well served by this decision.

Unless you can find 12 people in New York City that have been in a coma since 9/11 and suddenly awakened recently, can any libs on here tell me how Holder is planning to find a jury pool????? In fact, how is he planning to find 12 people in the entire country that don't have an opinion on 9/ll??? How is Holder planning to find a jury of KSM's "peers", unless he is planning on putting out a call for some of our home-grown terrorists who are also residents of NYC to serve on the jury? By announcing the verdicts in advance, the case is prejudiced and KSM walks. By announcing that he plans to never let KSM go even if he is acquitted, he has prejudged and sentenced KSM before the trial even starts. Holder is either grossly incompetent.....or worse.

The 9/11 attacks were not acts of war launched by a sovereign government, but criminal acts carried out by a cohort of individuals. Federal criminal court is absolutely the correct venue for these trials to take place.

Of course, there has been no precedent set of every having an enemy combatant (aka terrorist) captured on foreign soil by Americans put to trial in a Civil Court, but that doesn't stop Holder. He wants to set the precedent so all of them can be awarded a trial in Civil Court. This Administration is making a mockery of our judicial system as well as making a mockery of our Executive and Legislative branches as well.
